Committee Advises Policymakers on Inclusiveness in the Wake
of Michigan Proposition 2

The
Lawyers' Committee leads the charge in reacting to Michigans
Proposition 2, the November 7, 2006 state constitutional
amendment barring state and local public institutions from
using affirmative action programs in public employment,
contracting, and educational programs. Working with Ballard
Spahr LLP and the Leadership Conference on Civil Rights,
the Lawyers Committee provided an analysis to be used
by policymakers in Michigan and nationwide in their analysis
of the overall impact of the state constitutional amendment.
The analysis discusses the legal impact of Proposition 2
on any state or local public entity's use of any program
that considers or gives preferential treatment based on
race, color, ethnicity, gender, or national origin. The
analysis explains that various means of promoting racial
diversity and inclusiveness in classrooms, contracting,
and the workplace remain legal in Michigan.
